Understanding the New Duty to Prevent Sexual Harassment

Starting from 26 October 2024, employers will be legally required to take reasonable steps to prevent sexual harassment of their workers by their colleagues, as mandated by the Equality Act 2010.

The Equality and Human Rights Commission (EHRC) can take enforcement action against employers who breach their duty to prevent sexual harassment. If sexual harassment occurs it risks a tribunal claim, and a successful claim may lead to a discretionary increase of awards by up to 25%.
